DUI/DWI Penalties in Utah

Penalties for a DUI/DWI conviction in Utah include the following (the law can frequently change so please consult with an attorney):

  • First offense: minimum of two days in jail, $700 fine and 120 days license suspension
  • Second offense (within 10 years): minimum of 10 days in jail, $800 fine and one year license suspension, ignition interlock device
  • Third offense (within 10 years): minimum of 62 days in jail, $1,500 to $2,500 fine and one year license suspension, ignition interlock device

Three or more convictions within 10 years is considered a felony and carries with it up to five years in prison. DUI/DWI charges are also enhanceable crimes, meaning the charge can become more serious if there was bodily injury or a minor passenger under the age of 16 years.
